Supreme court rules Defense of Marriage Act unconstitutional, dismisses Proposition 8 appeal

0The Supreme Court struck a major blow for marriage equality today, declaring unconstitutional a key provision of the Defense of Marriage Act – the 1996 law that defines marriage as only between a man and a woman.

In a 5-4 decision, the court ruled that a same-sex couple, legally married in a state where same-sex marriage is legal, may receive federal benefits.

Justice Anthony Kennedy wrote the majority ruling. Chief Justice John Roberts, Justice Antonin Scalia and Justice Samuel Alito wrote dissents

According to CNN, legal expert Jeffrey Toobin put it this way: “DOMA is gone.”

In a separate decision, the court dismissed an appeal regarding California’s Proposition 8 case on standing, allowing same-sex marriages to resume there.
